Terms & Conditions

In this contract “the Photographer” shall mean Charles Tucker and Ginny Marsh and any other second photographer who may accompany them. “The Clients” are the couple whose names appear on the booking form attached. If the Photographer’s fees are being paid by a third party rather than the Clients themselves, then this contract is still deemed to be entered into between the Photographer and the Clients.


The Photographer’s services as specified on the attached booking form are supplied at the prices which are in force on the date of signature of this contract. Previously advertised lower rates will only be honoured upon the production of the relevant promotional literature and even then only at the discretion of the Photographer. Optional extras not paid for in full before the event are supplied at the prices ruling at the time of the additional order. The Clients will be liable to pay any additional expenses incurred by the Photographer not already included within the contract price. This may include any access fees charged by certain venues or postal charges for the secure dispatch of prints, discs, albums or other products.


A non-refundable booking fee of £200 (to be paid in cash or bank transfer) must be sent to the Photographer along with a completed booking form and signed contract to confirm your booking. Until this has been received and the payment has cleared, your event date cannot be reserved for you. The booking fee forms part of the total cost of your photography (i.e. it is not in addition to the advertised package prices) and is deducted from the total when calculating the final balance due. Payment of the final balance must be received by the Photographer in full no later than one calendar month after the event date. Please ensure that you allow sufficient time for the processing of bank transfers when calculating the due date for your final payment. Non-receipt of the full balance by the due date will result in the Clients being in default of this contract and the Photographer is therefore no longer obliged to provide any package content.


Please note that any alterations made to the event by the Clients after the booking has been confirmed may only be made at the discretion of the Photographer. Despite the best efforts of the Photographer to accommodate any alterations, some circumstances (such as a change of event date for example) may mean that the Photographer is unable to accommodate these alterations due to existing commitments. If this should occur, the Photographer is not liable to compensate the Clients in any way.

Force Majeure

The performance of this contract is subject to alteration or cancellation by the Photographer in extreme circumstances owing to any cause beyond their control (e.g. sudden illness or injury, victim of crime, severe weather conditions etc). In circumstances such as this, the Photographer will use his best endeavours to make alternative arrangements and will strive to fulfil his obligations under this contact by any means available to him. If, however, it proves impossible to attend the event despite his best efforts, the Photographer’s liability shall be limited to a full refund of any fees paid to him. In the unprecedented event that a re-shoot is needed, the Photographer shall not be responsible for any ancillary costs involved in staging the re-shoot apart from his own fees.


Any photographs taken during the course of the event will be at the discretion of the Photographer although every effort will be made to comply with the Clients’ requirements. The Photographer will endeavour to photograph all individuals as requested by the Clients, but the Photographer shall not be liable in the case of inadvertently missing a certain individual(s) or requested image. At most church ceremonies and at certain other venues, the Photographer’s movements may be restricted by the official in charge. The area from which the Photographer is allowed to cover the ceremony may not be the best location for an unobstructed view. The Photographer cannot therefore accept any responsibility for any partially obstructed view should this be the case.The photographing of certain parts or the whole ceremony may be prohibited and the Clients are strongly advised to check these details with the appropriate official before the event. The Photographer shall use his best endeavours to capture every required aspect of the event as it occurs. However, due to circumstances outside the Photographer’s control, including unrealistic time constraints, certain aspects may not be recorded and the Photographer cannot be held responsible in these circumstances. Should the Clients opt for coverage of the Bride’s preparations then the earliest start time will be 9:00am. Should the Clients opt for coverage of the speeches through to the first dance then this provides photography coverage until a cut-off time of 8:30pm. Should additional photography be required after this time, then further charges may accrue to cover the Photographer’s time (£100 per hour or part hour) and expenses.

Finished Product and Receipt of Goods

All images will be checked and edited to ensure that they are presented to the Client in the best possible way. Once edited and presented to the Client, the Client accepts that the images are of an acceptable quality, and no further editing or work will be carried out on the images without further payment.

Due to a variety of lighting conditions and the limitations of digital sensors, please note that very occasionally, some colours may alter slightly from their true hues and will not reproduce exactly in print. It is understood that due to the limitations of computer monitors, images will appear slightly differently according to the specification of each individual monitor. Every piece of the Photographer’s equipment and digital media is thoroughly checked before every event but in the highly unlikely event of a technical failure, the Photographer cannot be held responsible for any photographs that are not produced. Where images are made available for use on a PC or DVD player, reasonable steps are taken to ensure compatibility, but DVD discs may not play on all DVD players or PCs, particularly some older models. All images are provided as Jpeg files. Finished albums may take over six weeks to design during peak times and will take upto 8 weeks to be made. Please allow 28 days for delivery of all other orders. Where the Clients choose to design their album through Galileo Photography, they will be notified of the estimated completion date on a case by case basis. The Photographer must be notified either by telephone or email and it must be confirmed in writing (sent by Royal Mail special delivery) within three working days of the Clients receiving their order in the case of error, shortage or damage, as mistakes cannot be rectified after this period. Due to the nature of the finished albums, the Photographer is unable to give exchanges or refunds. This does not affect your statutory rights. Your selection of images for your Wedding Albums and Story Books must be submitted within 6 months of your wedding date. If you submit your selection after 6 months The Photographer has the right to charge for any increases in product prices that may have arisen. It is your responsibility to check any artwork for spelling mistakes, wrong dates and that all the images are included to your satisfaction. When designing the storybook you will receive thumbnails depicting each page. The Photographer reserves the right to charge for any extra changes. If this is the case, they will be charged at £15 per change. Once the thumbnails have been approved it will be your responsibility to pay for any additional charges to make any corrections that you may wish to make.


The Clients hereby allow the Photographer to display any photograph covered by this contract on his website or in sample albums or brochures or other such advertising use, provided that the images are used lawfully and without damage to the Clients. If the Clients wish to object to such use, they should advise the Photographer of this in writing before the event date.

Liability for Digital Files and Products

The digital files and hard copy photographs from the event shall become the property of the Clients upon collection of the same from the Photographer. At this time, responsibility for these products passes from the Photographer to the Clients, and the Photographer ceases to have any responsibility for their safe-keeping or reproduction. It is not guaranteed that the Photographer will keep backup copies of files or photographs from any previous events, so the Clients must take all steps necessary to ensure that adequate backup copies exist and are kept securely by them. Should any digital files or photographs be damaged or destroyed before coming into the Clients’ possession, the Photographer’s liability shall be limited to a refund of fees paid, but this shall not include a refund for any goods successfully supplied or capable of successful supply. The photographer will not be liable for happenings beyond his control which may lead to loss of image files.

Cancellation Fees

If the Clients have to cancel a confirmed booking, the following cancellation fees will become due immediately upon the cancellation:

  • Cancellation from the date of confirming the booking up until three months before the event date –  The non-refundable retainer only (See Payments clause above)
  • Cancellation less than three months before the event date – The full price for the photographic package booked

Where the Photographer is able to re-book the event date with an equivalent booking, then the cancellation fee may be reduced to the non-refundable retainer at the Photographer’s discretion


The Clients are advised to consider taking out an insurance policy to cover any expenses in the event of a cancellation due to unforeseen circumstances. The Photographer holds fully comprehensive insurance specifically designed for wedding photographers, together with full public liability cover


The Photographer may store your data in hard copy form, on a secure private PC and online in a secure private archive. This data will not be made available to any outside companies or individuals without the prior written permission of the Clients

Governing Law

The contract made between the Photographer and the Clients shall in all respects be governed by and construed in accordance with English Law and the parties hereto submit to jurisdiction of the English courts


I confirm that the details on the attached booking form are accurate to the best of my knowledge. I have read and understood the above and agree to abide by the terms of this contract. I understand that the terms of this contract cannot be changed unless agreed in writing by the Photographer. I understand that this contract becomes effective immediately upon my signing the same and agree that my retainer is not refundable and cancellation rates will apply in the event of any cancellation by me
